Privacy Policy

This privacy policy (the "Policy") applies to the services provided by Tamares Hotels Chain in Israel, which include: the services provided at the Daniel Herzliya Hotel and Shizen Spa (together "Tamares" "we" or "us"), and through our website available at www.tamareshotels.com the "Website" and "Services").
We have prepared this Policy to explain more about who we are and how we collect and manage your information.
By using any of our products or Services and/or by agreeing to this Policy, by any other means, you understand and acknowledge that we will collect and use Personal Data as (defined below) described in
this Policy.
 
If you are an individual based in the EU please note that in some limited context, certain limited personal data that we process may be subject to the EU General Data Protection Regulation 679/2016 (the "GDPR").  
 
Information we may collect from you
We collect "Personal Data" (which means any information that can personally identify you directly or indirectly, as defined under the GDPR) from you voluntarily when you provide such Personal Data to us, or via our Services with which you interact. We may also be given other Personal Data relating to you by other persons, or we may obtain such other Personal Data about you as may be provided to us in the course of our legitimate business activities.
You do not have to provide us with your information. However, in some cases, if you choose not to share your information it may mean that you are unable to use our services.  For example, we may be unable to complete any booking you may wish to make, or you may be unable to participate in our loyalty programs.
In the course of providing services to you, we may collect and process Personal Data, including the following, which might contain your personal data (collectively "Personal Data"):
 
  • When you browse or visit our Website. When contacting us through the Site, we may collect your full name, email address and phone number and any additional information you may choose to disclose to us. We will collect and process this data in order for us to be able to fully address your complaint or request. The legal basis for this collection and processing is your consent.
During your visit to the Site we may also collect Cookies. For more information, please read the section in the Policy regarding Cookies.
 
  • When you book a room, a spa treatment or any other service we provide. When booking a room or ordering any of the other services we provide, we may collect your full name and address, email address, phone number, passport details, family ties, nationality, car registration number, driving license, financial information about you, including your bank account details, credit card details, or other payment methods details; membership in professional or other organizations; date of birth and/or anniversary; details of your children and other relations. We may collect and process such Personal Data to supply our services to you, and provide you with the accommodation and services you ordered. Some of the Personal Data may also be required for us to fulfill our legal obligations. Our legal basis for this is your consent, together with the need to fulfill our contract with you when you order our services. When relevant, legal obligations may also be the basis for collection and processing this Personal Data.
 
  • When you book a room, a spa treatment or any other service we providethrough a third party. When making a booking or an order for a service we provide through a third party, we may collect the details of the contracts you have entered with such third parties, for us to be able to provide the services to you. The legal basis here would be the need to fulfill the contract, and your consent.   
 
  • When you inform us of special requirements regarding your reservation. In such cases, we may collect medical information, including details of allergies; any disabilities or other medical conditions, and any other relevant data you decide to disclose to us. The legal basis here would be the need to fulfill the contract, and your consent.   
 
  • When you use media services. When you use our media services we may collect data regarding the media content you have watched or subscribed to during your stay in our hotels. We collect and process such data in order to tailor our services to your personal preferences. The legal basis here would be the need to fulfill the contract, and your consent. 
 
  • When you stay in our premises. When you stay in our premises, we may collect CCTV camera footage that includes you. We collect and process such footage to help us ensure the safety and security of both our staff and visitors. The legal basis for this is our legitimate interest in doing so.  
 
  • When you access our Wi-Fi facilities. When you access our wi-fi facilities we may collect your email address or social network account. We will do so in order to provide you with the Wi-Fi services. The legal basis here would be the need to fulfill the contract, and your consent. 
   
 
Finally, please note that some of the abovementioned Personal Data will be used for detecting, taking steps to prevent, and prosecution of fraud or other illegal activity, to identify and repair errors, to conduct audits, and for security purposes. Personal Data may also be used to comply with applicable laws, with investigations performed by the relevant authorities, law enforcement purposes, and/or to exercise or defend legal claims. In certain cases, we may or will anonymize or de-identify your Personal Data and further use it for internal and external purposes, including, without limitation, to improve the services and for research purposes. “Anonymous Information” means information which does not enable identification of an individual user, such as aggregated information about the use of our services. We may use Anonymous Information and/or disclose it to third parties without restrictions (for example, in order to improve our services and enhance your experience with them).
How we secure your information
We are committed to protecting the security of your Personal Data. We use a variety of organizational and technical measures, as well as to help protect your Personal Data from unauthorized access and use. However, the collection, transmission and storage of information can never be guaranteed to be completely secure, and it depends both on our systems and security measures and your device and network. We take steps to ensure that appropriate security safeguards are in place to protect your information, and we will continue to revise policies and implement additional security features as new technologies become available. As the security of information depends in part on the security of the computer, device or network you use to communicate with us and the security you use to protect your user IDs and passwords, please make sure to take appropriate measures to protect this information.
 
Retaining Your Information in our systems
We generally only keep your information for as long as is reasonably required for the reasons explained in this Policy. We keep certain Personal Data if required under laws and regulations we are subject to. In some cases, we keep transactional records (which may include your personal data) for long periods if it is necessary to meet legal, regulatory, tax or accounting needs. We will also retain information if we reasonably believe there is a prospect of litigation. 
 
Share, transfer and disclosure of Personal Data
We may share, transfer or disclose your Personal Data in the following circumstances:
  1. We may disclose your Personal Data to third party service providers and/or our affiliated companies for the purpose of providing services to you, for example the processing and fulfillment of your reservations;
  2. We may disclose your Personal Data to regulators, courts or competent authorities, in accordance with applicable laws and regulations (e.g. when we have a legal obligation to do so), or when we are allowed to do so under our legitimate interests;
  3. If, in the future, if we will sell or transfer, or we will consider selling or transferring, some or all of our business, shares or assets to a third party, to the maximum extent permitted by Applicable Laws, we will disclose your Personal Data to such third party in connection with the foregoing events;
  4. To the maximum extent permitted by Applicable Laws, we will transfer your Personal Data in the event that we are acquired by, or merged with, a third party entity, or in the event of bankruptcy or a comparable event; the transfer shall be in connection with the foregoing events.
International transfers:
  • Where we transfer Personal Data originating from Israel of the EEA outside of these jurisdictions (for example to third parties who provide us with services)we rely on (i) Adequacy Decisions as adopted by European Commission on the basis of Article 45 of Regulation (EU) 2016/679 (GDPR), or (ii) Standard Contractual Clauses issued by the European Commission. You may also request certain details of the basis on which your Personal Data is transferred outside the European Economic Area, but data transfer agreements and/or other details may need to be partially redacted for reasons of commercial confidentiality;
  • Any requests for information we receive from law enforcement or regulators will be carefully validated before the disclosure of any Personal Data.
 
Your privacy rights 
The following rights (which may be subject to certain exemptions or derogations) shall apply to certain individuals (some of which only apply to individuals protected by the GDPR):
  • You have a right to access Personal Data held about you.
  • You have a right to correct your Personal Data - you can ask us to correct any of your Personal Data which is incorrect or misleading, after verifying the accuracy of the data first;
  • You have a right to erase your Personal Data - you can ask us to erase your Personal Data if you think we no longer need to use it for the purpose we collected it from you. You can also ask for such erasure in any case in which the process of your data was based on your consent, or where we have used it unlawfully or where we are subject to a legal obligation to erase your Personal Data. Any request for such erasure will be subject to our obligations under the law (e.g. our obligation to keep some records for tax or customs purposes), and our data retention policy mentioned above;
  • You have the right to object to profiling;
  • You have a right to restrict our use in your Personal Data - you can ask us to restrict our use and processing of your Personal Data in certain circumstances;
  • You have a right to object to how we use your Personal Data - you can object to any use of your Personal Data which we have justified by our legitimate interest if you believe your fundamental rights and freedoms to data protection outweigh our legitimate interest in using the information;
  • you can require us to refrain from using your data for direct marketing purposes;
  • You have the right to data portability. This means that you may have the right to receive your Personal Data in a structured, commonly used and machine-readable format, and that you have the right to transmit that data to another controller;
  • You have the right to withdraw your consent at any time. Please note that there may be circumstances in which we may be entitled to continue processing your data, in particular if the processing is required to meet our legal and regulatory obligations. Also, please  note that the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal;
  • You have a right to lodge a complaint with your local data protection supervisory authority at any time, or before any other relevant institutions. We ask that you please attempt to solve any issue with us prior to contacting any such bodies.
 
We may not always be able to do what you have asked, for example, if it would impact the duty of confidentiality we owe to others, or if we are otherwise legally entitled to deal with the request in a different way. Please note that we may require you to give additional information in order to verify your identity, or in order for us to fulfill your request. In the event that your request would adversely affect the rights and freedoms of others (for example, would impact the duty of confidentiality we owe to others) or if we are legally entitled to deal with your request in a different way than initial requested, we will address your request to the maximum extent possible, all in accordance with applicable law.

We do not offer any of our services directly to individuals under the age of eighteen (18). If you are under the age of eighteen (18), please do not provide us any Personal Data without the involvement of a parent or guardian. If we become aware that you have provided us with Personal Data and that you are under eighteen (18), we reserve the right to delete your Personal Data. If you provide us any Personal Data about children who are guests in the hotel, you warrant and represent that you are the parent or legal guardian of the said children and you are permitted to provide us with this Personal Information.   
 
Special Notification for California Residents
Individual customers who reside in California and have provided their personal information to us may request information about our disclosures of certain categories of personal information to third parties for their direct marketing purposes. We reserve the right to change this Policy from time to time at our sole discretion. If we make any changes, we will post those changes here so that you can see what information we gather, how we might use that information and in what circumstances we may disclose it. Governing Law
The laws of the State of Israel will govern this privacy policy, excluding its rules of choice of law. The competent courts of Tel Aviv-Yafo shall have exclusive and sole jurisdiction over any  disputethat mayarisein connection with this privacy policy.
